These terms and conditions (the "Terms and Conditions") govern the use of the service at www.EndlessHour.com (the "Site" aka "Endless Hour" / "Service"). This Site is owned and operated by Bounce the Line Ticketing Inc. This Site is an ecommerce service directed at restaurants and other establishments that want to improve the guest experience through our online service.
By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times. You will also have understood the Privacy Policy before using our site. The Purchase Agreement will be applied to any guest who carries out any payments to / from Bounce the Line Ticketing Inc. This agreement remains in effect even if we update these terms or other terms you agreed to. We will notify you of any changes by email. It's your responsibility to review the terms at least once a quarter (every 3 months). You can find the latest terms on our website, EndlessHour.com/terms.
Intellectual Property
All content published and made available on our Site is the property of Endless Hour and the Site's creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site.
Accounts
When you create an account on our Site, you agree to the following:
- You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account;
- All personal information you provide to us through your account is up to date, accurate, and truthful, and you will update your personal information if it changes.
We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.
Age Restrictions
The minimum age to create an account and subscribe on our Site is 18 years old. By using this Site, guests agree that they are over 18 years old. However, individuals under 18 may still experience the service as an accompanied guest of a subscribed user (the "main guest"). We do not assume any legal responsibility for false statements about age.
Acceptable Use
As a guest of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
- Harass or mistreat other guests of our Site;
- Violate the rights of other guests of our Site;
- Violate the intellectual property rights of the Site owners or any third party to the Site;
- Hack into the account of another guest of the Site;
- Act in any way that could be considered fraudulent;
- Post any material that may be deemed inappropriate or offensive; or
- Anything that is deemed by the service as improper.
If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend, or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.
User Contributions
Guests may post the following information on our Site:
- Photos;
- Public comments; and
- Event details (limited to verified establishments only).
By posting publicly on our Site, you agree not to act illegally or violate these Terms and Conditions.
License to the Endless Hour Services
Your Limited Use of Our Services
We grant you permission (license) to use our platform in a specific way:
- Browsing and Experience Participation: You can search for premium experiences or premium deals/values from establishments, view details, register, and purchase offers.
- Establishment Use: Establishments can create premium experience or deal offerings, manage promotions, track redemptions, and collect payments.
Restrictions
You cannot copy, sell, or misuse our platform in a way that harms us. This includes:
- Copying, modifying, or creating unauthorized versions of our services;
- Trying to uncover our source code or internal workings;
- Using our platform for commercial purposes beyond its intended use or exploiting it in any way;
- Removing or altering copyright notices;
- Disrupting or interfering with the platform's functionality.
Ownership of Content
All content on our platform (Site Content) is protected by intellectual property laws. We may own this content, or it may be licensed from third parties. You can only use this content as permitted by these terms and relevant laws. All rights not expressly granted to you belong to us.
Chargebacks and Fraud Protection
Guests agree not to issue chargebacks on legitimate transactions. Fraudulent disputes may result in permanent suspension from the platform. Endless Hour reserves the right to contest chargebacks and recover funds as needed.
Establishment License Agreement
This agreement becomes binding once agreed through creating an account and is specific to establishment accounts.
- Non-Transferable License
The rights and obligations outlined in this Agreement are personal and granted solely to the establishment. The establishment is strictly prohibited from transferring or assigning any of these rights or obligations to any third party or legal entity. Additionally, the establishment may not permit third-party access or use of the software. - Structure
Payouts occur whenever the establishment requests them. The first payment may take up to 14-21 days to process, but future payments should be expedited and quicker, provided the establishment’s bank account details remain unchanged. - Promotional Awareness
Promotional materials (such as a special menu, social media awareness, a Endless Hour badge on the website, or staff training) must be maintained for guest awareness. If you do not take our advice, the platform cannot prosper and will not be a useful success for the establishment. For the best profitable success, all advice should be applied appropriately. - Failure to Deliver Quality
If an establishment fails to deliver a quality experience and does not improve after reasonable attempts, they will be removed from the service. This means that if staff are not educated, informed, or do not create awareness and an exclusive premium experience for subscribed guests, the partnership will not be fruitful and may lead to disbarment or removal from Endless Hour. - Establishment Compliance
Establishments must adhere to all applicable laws, health codes, and licensing requirements. Failure to comply may result in removal from the platform.
Guest Behavior and Expectations
Guests must follow all establishment rules. Disruptive or inappropriate behavior may result in removal from an establishment and possible suspension from Endless Hour.
Dispute Resolution
Endless Hour will mediate disputes between guests and establishments where possible, but final resolutions remain at our discretion.
Payments and Payouts
Guests pay establishments through our platform. A $0.99 USD non-refundable fee applies per transaction. Establishments may request payouts at their discretion.
Subscriptions
Your subscription automatically renews, and you will be automatically billed until we receive notification that you want to cancel the subscription. To cancel your subscription, please do so on the subscription/billing page. When subscribed to a deal, it entails automatic email campaigns that the restaurant may send periodically which the user may not unsubscribe too if they are subscribed to the deal.
Refunds
Refunds are discouraged; service continues until the subscription ends. If an establishment fails to honor a subscription, Endless Hour will mediate but cannot guarantee a resolution.
Severability
If any provisions of these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected and will remain valid.
Indemnity
Except where prohibited by law, by using this Site, you indemnify and hold harmless Endless Hour and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Limitation of Liability
Endless Hour and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the Site.
Changes
These Terms and Conditions may be amended from time to time to maintain compliance with the law and reflect changes to our Site and user expectations. We will notify users by email or post a notice on our Site about any changes.
